I. Basic provisions

The controller of personal data under Art. 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the “GDPR”) is Wellness Hotel Lužan, Lužické náměstí 212, 408 01 Rumburk, Czech Republic, company ID 28728271 (the “controller”).

Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

The controller has not appointed a data protection officer.

II. Sources and categories of processed personal data

The controller processes the personal data you have provided through the enquiry form, or personal data obtained in the course of fulfilling your order.

This means your contact detail (e-mail or phone), the type of event, the number of guests, the date of the event and the text of your message. We also record the language in which you submitted the enquiry so that we can reply in the same language.

III. Legal basis and purpose of processing

The legal basis for processing is the performance of a contract between you and the controller under Art. 6(1)(b) GDPR, including steps taken at your request prior to entering into a contract, and the controller's legitimate interest in answering your enquiry under Art. 6(1)(f) GDPR.

The purpose of processing is to handle your enquiry and to exercise the rights and obligations arising from the contractual relationship between you and the controller. Without your contact details the enquiry cannot be handled.

The controller does not carry out automated individual decision-making within the meaning of Art. 22 GDPR.

IV. Retention period

The controller keeps personal data from the enquiry form for 24 months from the last contact and deletes it afterwards. Data on tax documents is kept for the period required by law.

V. Recipients of personal data

Recipients of personal data are persons involved in delivering the services under the contract and persons providing the operation of the website and e-mail services.

The controller does not intend to transfer personal data to a third country (outside the EU) or to an international organisation.

VI. Your rights

Under the conditions set out in the GDPR you have the right of access to your personal data under Art. 15 GDPR, the right to rectification under Art. 16 GDPR or restriction of processing under Art. 18 GDPR, the right to erasure under Art. 17 GDPR, the right to object to processing under Art. 21 GDPR, the right to data portability under Art. 20 GDPR and the right to withdraw consent in writing or electronically at the address or e-mail of the controller set out in Art. I of this policy.

You also have the right to lodge a complaint with the Czech Data Protection Authority (Pplk. Sochora 27, 170 00 Prague 7, uoou.cz) if you believe your right to the protection of personal data has been infringed.

VII. Security of personal data

The controller declares that it has taken all appropriate technical and organisational measures to secure personal data, both in electronic storage and in paper form. Only persons authorised by the controller have access to the personal data.

VIII. Final provisions

By submitting the enquiry form you confirm that you are familiar with this privacy policy and that you accept it in its entirety.

The controller is entitled to amend this policy. A new version will be published on its website.
